Section 10 reporting
Requirements of the review
Under Section.10 (1) of the Water Management Act 2000 No 92, the Minister is required to review the work and activities of the Department at intervals of not more than five years. The review is required to:
- “ensure that the work and activities of the Department… have been effective in giving effect to the water management principles of this Act and the State Water Management Outcomes Plan." (the Act, s.10 (1)).
The results of each review under this section are to be included in the relevant annual report for the Department (s.10(2)). This section provides an overview of the requirements for the review, and the current status and approach.
Section 10 review 2017-2022
The Department has completed a Section 10 review for the period July 2017 to December 2022. This review applied the Section 10 review method for the first time.
The review assessed a broad range of the Department’s activities under the Act and focused in detail on the following areas:
- Water sharing plan development
- Water management plan amendment
- Water restrictions (s.324 orders)
- Water supply work approvals
- Available water determinations
- Compliance enforcement
- Regulations and orders.
The Department has committed to addressing the review’s recommendations in its response to the Section 10 review.

A contemporary method has been developed for undertaking Section 10 reviews allowing reviews to be conducted in a consistent manner. The method, although subject to update as required, is designed to be enduring, provide clarity and apply consistent criteria.

This document provides a method for the review of the work and activities of the Department under the requirements of s.10 of the Water Management Act 2000 (NSW) (the Act). It is designed to be a user guide for NSW public servants or contractors responsible for the s.10 Review(s).

Previous Section 10 reviews
Previous Section 10 reviews completed in 2007 and 2011 pre-date the contemporary method. Future Section 10 reviews will apply a consistent method.
