Privacy and personal information collection notice

Purpose

Your personal information is being collected to enable the Recipients to exercise their community engagement functions in relation to the Department of Planning and Environment (the department) water program or projects including but not limited to projects under the NSW Sustainable Diversion Limit Adjustment Mechanism (SDLAM) program.

Recipients

The department and the Department of Regional NSW (DRNSW), including persons engaged or employed by these agencies for the above stated purpose.

What information we collect

When you register your interest, make an enquiry or leave a comment on or via the website we may collect personal information about you.

We may also collect personal information from you directly when you:

  • ask us to contact you after visiting our website
  • contact us via telephone
  • contact us via email
  • have contact with us in person.

The types of personal information we may collect includes*:

  • your name
  • your address
  • your telephone number/s
  • your email address
  • any information you provide to us when you make an enquiry or through correspondence.

How we will use and disclose your personal information

We will only use or disclose your personal information between the Recipients for the purpose of exercising the function of community engagement in relation to the department’s water program or projects including but not limited to projects under the NSW SDLAM program. This includes:

  • sending you information and updates about the program
  • organising events to facilitate stakeholder consultation and collaboration about the program
  • responding to an enquiry or request received about the program.

The Recipients will not provide your personal information to anyone outside the department and DRNSW without your consent, unless required to by law.

You can opt-out of our database and/or being contacted by making a request in writing to winsw.engagement@dpie.nsw.gov.au. If you do so, you will no longer receive information and updates about SDLAM.

Supply

Voluntary. However, if you choose not to provide your personal information, we may not be able to forward the material that you are requesting or contact you to about consultation or collaboration opportunities in the future.

Storage

The Recipients will store this information on their respective records management system in line with the department’s and the DRNSW Privacy Management Plan.

Stakeholder information is stored in the following way:

  • In the department’s stakeholder management tool, Borealis, and the department’s document management system CM9. Borealis can be accessed by the Recipients and system administrators and CM9 by the department’s staff only. Borealis complies with NSW Government information security requirements. The data is stored on servers across two sites in Sydney, NSW. Details are stored by the department for five years.
  • In the DRNSW Local Land Services stakeholder management tool, FARMS and the MyLLS databases which are hosted on servers located in NSW. Documents saved to FARMS and MyLLS will be stored in DRNSW’s document management system CM9. FARMS and MyLLS can only be accessed by DRNSW staff and system administrators. Data is stored in accordance with DRNSW document and data retention periods as well as business needs.

Users of the systems manage data and protect personal information as required under the Privacy and Personal Information Protection Act 1998 (PPIP Act).

Access and correction

Under the PPIP Act you have the right to access your personal information held by the Recipients without excessive delay or expense. You also have the right to seek amendment of your personal information in certain circumstances (e.g. if it is incorrect).

Complaints: If you are concerned that there has been a breach of your privacy under the Privacy and Personal Information Protection Act 1998, you can make a complaint to the Recipients or to the NSW Privacy Commissioner, www.ipc.nsw.gov.au. You can also make a complaint to DPE or DRNSW as per their Privacy Management Plans.
